Terms + Conditions
When the client receives their quote they will also receive these Terms and Conditions. When the client has accepted Pop Creative Ltd’s quote, they are also accepting Pop Creative Ltd’s Terms and Conditions. Please see below.
The following Terms and Conditions apply to all products and services provided by Pop Creative Ltd (hereinafter referred to as Pop Creative). All work is carried out by Pop Creative on the understanding that the client has agreed to our terms and conditions.
Project Acceptance
At the time of proposal, Pop Creative will provide the client with a written estimate or quotation by email. As designs tend to evolve and change during the concept process with the client, it’s likely the quote will change too. We will do our best to keep the client up to date with cost changes. We quite often cannot get a final price until the work goes to print, as a large majority of our prices are built up with print costs. It’s not until we have the final artwork that the printer can give us a final cost. As our work is very bespoke, we don’t have set prices for everything.
Design Charges
Charges for design services to be provided by Pop Creative will be set out in the written estimate or quotation that is provided to the client. Within reason, we allow the customer to have two design revisions as part of the cost. Any revisions thereafter will be charged out at $95 + gst per hour. It’s therefore really important that you proof your content before you send it to us, and that you take enough time to confirm your ideas, feedback, and inspiration before we commence the design process.
Final Design for Proof
We will supply proofs in a PDF file which is appropriate for printing. It’s the client’s responsibility to confirm that the proof is OK for print. Once we have that confirmation, we will send the work to print. We take all care and no responsibility for spelling, grammar and content. Please triple check your proof!
The customer agrees that Pop Creative holds no responsibility for any amendments or defects and will not be held responsible for any or all damages resulting from such claims. We will always do our best to ensure all items are delivered on time. Pop Creative is not responsible for any loss, or non-delivery of products or services, of whatever cause. The customer agrees not to hold Pop Creative responsible for any such loss or damage.
Payment
The client will be issued an invoice once the proof is signed off. Payment is required within five working days, or before delivery of printed items (whichever is closer). Accounts which remain outstanding for 10 days after the date of invoice, will incur 5% interest late payment fee for every week thereafter.
Alterations
The client agrees that changes required; over and above the estimated work, in addition to the agreed scope, changes to the supplied copy or changes required to be carried out after acceptance of the final proof will be liable to a separate charge.
Design Project Duration
When Pop Creative provides the client with a quote, Pop Creative will also provide the client with a time line. The client must meet all deadlines in order to allow concept development and feedback between Pop Creative and the client. This will ensure Pop Creative can spend enough time on the design phase and get the job to the printers in time.
Although Pop Creative will always go above and beyond for their client, if the client fails to meet any of the deadlines, and therefore misses the print deadline, the client will still have to pay for Pop Creative’s design time and materials already purchased.
Disclaimer
Pop Creative makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Pop Creative will not be held responsible for any and all damages resulting from products and/or services it supplies.
Pop Creative is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The client agrees not to hold Pop Creative responsible for any such loss or damage.
Pop Creative reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. Pop Creative will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
Acceptance of Terms + Conditions and Quotation
The placement of an order for design and/or any other services offered by Pop Creative, by email, verbally or in writing, is deemed to be acceptance of these terms and conditions.
